Swedish prosecutors to target Pirate Bay with charges before 2008

Swedish Prosecutor H�kan Roswall has revealed his intentions to file charges against the operators of the popular Pirate Bay BitTorrent site before January 1st, 2008. Five of the operators would be charged with crimes related to copyright infringement. Of the five, two are mentioned; administrator Brokep, or Peter Sunde and Carl Lundstr�m.

The announcement comes after comments made earlier in the year in which Roswall vowed to target the Pirate Bay. The site's operators maintain that it is only a search engine, hosts absolutely no infringing content and operates completely compliant with Swedish copyright law.

Roswall hopes that a May 2006 raid, in which over 180 servers at the host of the Pirate Bay were seized, will provide enough evidence of criminal activity. However, a leak regarding the raid revealed that the Swedish police got little or no incriminating evidence against the service or its operators.

Responding to May 2007 comments, administrator Tobias Andersson explained that the police need to do something to save face. "Of course we don't think they will succeed," he said, "I think they feel they have to do it. It would look bad otherwise since they had 20 to 30 police officers involved in the raid � we will most likely be cleared as it is obvious that there is no copyrighted material on the site, there are just links to other places."

Hm.. Doesn't sound like very good news for TPB. TPB is really pushing their luck. Look at it like this; TPB says the site is nothing more than a search engine, however it's PROMOTING copyrighted material, POINT BLANK. I dunno.. I haven't looked @ the Swedish laws, but if a Swedish Prosecutor was knocking on the doors of my website I would shut it down in a heartbeat. If you read the "legal threats" on TPB's site, you will see that TPB doesn't give a damn about what any other country thinks about what they are doing.... Best of luck, PB. WE NEED DEMONOID BACK! Sure, its site is only a search engine, but what about its tracker. My only conclusion from the quote above is that the tracker servers were elsewhere and that they were not confiscated during the raid. Trackers are where the main legal grey aere is, as they connect machines hosting the said infringing material. At least some of them in the past have also allowed identification of the trackers' users, although I'm not aware of how well TPBs trackers are able to cloak identities (I'm sure that they would have been quite canny in masking IP addresses etc.). What is RIAA going to do if they ever find that people are using USPS to trade copyrighted material? Sue the entire US? And who cares if TPB is "promoting copyrighted material"? If I stand on a corner and yell "MURDER THE PERSON NEXT TO YOU!!!" all day, am I liable for any deaths that occur in the area? Even IF it could be proven that it was a murder, AND that the murderer had heard me before deciding to do it, how much liability could a judge or jury POSSIBLY assign to me? 1/10000000000th? Same with TPB - they're not COMMITTING any crime, no matter how much they might be encouraging it. [ + quote]
