Apple Computer Inc. has yet again been hit by a lawsuit concerning the company's iPod music players and again, this lawsuit concerns the easily scratched iPod Nano. The company is being sued by a consumer group that claims the company is breaking product warranty by charging $25 for replacement of defective Nano players. Los Angeles-based Foundation for Taxpayer and Consumer Rights claims that the device cannot endure normal usage without getting scratched to the point where it becomes unusable.
The suit was filed Thursday in San Mateo County Superior Court. It demands that Apple replace defective units for free or refund the purchase price if the customer wants it, and it also demands that Apple add scratching and cracking to its warranty coverage. An Apple spokesman declined to give any comments as it is company policy not to comment on pending litigation.
Over 42 million iPods have been sold worldwide; 30 million of those units were sold last year. The law firm behind the latest Nano suit, Cotchett, Pitre, Simon & McCarthy of Burlingame, is seeking class-action certification. The same firm won a settlement last August over old model iPod batteries.

Oh yes!!! About bloody time someone did something about this! The way Apple has treated its customers over the whole scratched Nano fiasco has been atrocious!
Anyway, mini-rant over, go back to your desks people, there's nothing to see here...

About Ipods theres going to be a new one in April. It's suppose to be the whole screen and it has a virtual wheel ,I think it's going to be a great Ipod. Brings me back to this though it could be easily scratched because of the constant touch screen.

I don't only feel like this about ipod/apple. I feel like this about ALL companies:
If I spend my f*ckin money on the sh*t you sell. Then it's f*ckin MINE. And if you sell cheap shit that f*cks up because you're a cheap b*st*rd, and didn't tell me: then you lieing sack of sh*t, you deserve to be sued till you go broke and someone more respectable can move in and sell there stuff for me to buy!

ppl just need to take care of their own ish..
and you think something that fragile wont scratch? you must be on something? did you not see it before you bought it? you bought it because its the new hot toy.. because you had to be the first one on your block to have one?
have ppl become this shallow?

They shouldn't being making nanos if you can't even put them in your pocket without scratching it. It's not that people aren't taking care of them, it's that Apple made a piece of SH*T product. I know if I had bought one and put it in my pocket and it got scratched I would be mad as h*ll too.

Cases are fine, and I'm all for a nice one, but the iPod does scratch rediculously easy. Does your cell phone screen scratch this easy? Does the PSP scratch up this easy? Your PDA? Your watch? Anything that you can think of with a screen? Probably not.

I think that they should have to pay the people back all of their money, as a lesson for market research. In this day and age, it is completely ridiculous to release a product with a flaw like this. They should have to compensate all of these people.

ok i have a nano and its scratched up like you wouldnt belive even wen i had a case on it, so if i bring it to apple they will replace it because its considered a defect?
