Canada is a "haven for pirates" says Microsoft Corporate giants Microsoft and Apple recently asked the US Government to place Canada on its high priority piracy list arguing that the country was not doing enough to prevent the piracy of it's products.
The government however decided against it and Canada was placed instead on the lower priority list for the fourth year in a row.

It joins other countries such as Belarus, Belize, Bolivia, Brazil, Colombia, Costa Rica, Dominican Republic, Ecuador, Guatemala, Hungary, Indonesia, Italy, Jamaica, South Korea, Kuwait, Lithuania, Malaysia, Mexico, Pakistan, Peru, Philippines, Poland, Romania, Saudi Arabia, Taiwan, Tajikistan, Turkmenistan, Uzbekistan and Vietnam.

The International Intellectual Property Alliance (IIPA) which represents companies like Apple and Microsoft, stated in their reoprt that "Canada’s long tenure on the USTR Watch List seems to have had no discernible effect on its copyright policy. Almost alone among developed economies in the OECD, Canada has taken no steps toward modernizing its copyright law to meet the new global minimum standards of the WIPO Internet Treaties, which Canada signed a decade ago. Its enforcement record also falls far short of what should be expected of our neighbor and largest trading partner.

"Pirates have taken advantage of the gaps in Canadian law to make it a leading exporter, both of camcorded masters that feed audio-visual piracy worldwide, and of devices – illegal in most global markets besides Canada – that are intended to circumvent technological protection measures used by the publishers of entertainment software. Canada lacks effective border controls on pirated products, and most of its other enforcement efforts suffer from insufficient resources and a lack of deterrent impact.

"To underscore U.S. insistence that Canada take action to address the serious piracy problem it has allowed to develop just across our border, and that it bring its outmoded laws up to contemporary international standards, IIPA recommends that Canada be elevated to the Priority Watch List in 2007."


After the government declined the IIPA's request, the group expressed disappointment adding that Canada "continues to stand almost alone among developed countries in its failure to implement the obligations of the two WIPO digital treaties, and weak enforcement in both hard goods and Internet piracy continues to cause great damage to legitimate rights holders, both of Canadian and US copyright products."

Oh no we are a bunch of pirates!! puhlease!! The only pirates i know about are In the states. Not to say there isn't any up here. But the fact of the matter is, is that the US (and is some respects canada's) government is controlled by commercial interests and lobby groups (none of this would even be an issue if it weren't for M$ and Apple telling the government to jump and the government saying how high! and I'm sure the MPAA and RIAA had something to do with it too)

The US invading canada? Highly unlikely as the Treaty of Ghent in 1814 that ended the war of 1812 specifically prohibits both sides from invading the others nation. (But knowing GW and his thirst for the black gold anything is possible...could be a nice what if alternative history novel plot there!!)

Besides all of us up here will agree to disagree and ignore the label seeing the US government has no say in our law making process. (they can't make our laws, they can only complain and SUGGEST courses of action) I think both governments have other important things to worry about than the profit taking pigs at the trough that is MPAA, RIAA, M$ and Apple.

As an effort to steer this topic back on course somewhat, I'll just toss out what my understanding of Canadian copyright law in regards to the internet is (as I am a Canadian).

Anyways, I believe it is not illegal to download copyrighted materials from the internet, but it is illegal to upload them or to make them available for download. Now that being said, to my knowledge, there has never been anyone fined/jailed/arrested for uploading in Canada. I don't think these laws are enforced very much if at all. I think it's a situation of it being illegal but there is no penalty.

Of course, if you were to show up at the premiere of Spiderman III with your Sony Handycam, you would get kicked out and authorities would be involved. So it's not like piracy runs rampant here, it's just d/l'ing is penalized.

Actually, as far as I remember, it is legally allowed to bring a handycam. But each theatre has its own policies, so the theatres ban it.

I have never heard of such an arrest and have lived here for more than 50 years. Canada is different, for now. A federal judge ruled that making a copy of a cd, for example, was no different than having a photo copier in a library. This decision is under appeal but the Supreme Court has not, to my knowledge, stated whether or not it will hear the appeal. The federal judgement has to be faulty and it isn't. That would mean Parliament will have to enact a new law. The current government will probably try but it is in a minority position and can't always get what it wants.

I do believe that you can download 1 copy for your own use, but you cannot reseed it back out. I have only heard of 1 case were someone was charged a few years back for shareing, but it was in the gigs that he was shareing out. That was also when the lawyers tried to get isps to release there client lists and information. If I remeber right that was squashed by the courts.

Also you can make 1 copy of any disc you own as a personnal backup only. You are not to lend or give copies out to anyone.

Also you say canada does nothing about pirates. Some isps when they get a complaint from a big group, they will send out warnings to the people that download large numbers. They also have watchdogs out there, especially if they see a lot of uploads/download from a certain address. I know a few people that got warings from symantec about download.

And yes, before you ask. I am Canadian.

BigE it is illegal to download copyrighted material from the internet. It is even illegal to copy copyrighted material in the library, record the radio or TV shows etc. However, those acts really do not cause much harm in a legal sense and except for the library copying, nearly impossible to detect. The same hold true for the internet. There is almost no way to detect someone copying something on the internet. The precedent has already been set not to prosecute these harmless acts. It is possible to identify users uploading to the internet or making copyrighted material available to internet users. That becomes distribution and that has always been prosecuted. In that context, the media mafia stands on solid ground.

The US uses everyone.

The statement I was making is we don't need to.

US policy = use up everyone's resource's then use ours.

Doesn't it look just a little odd that we sell our oil to everyone else, rather then use it?
And buy from canada, the middle east & russia?

Cheaper to buy from everyone else, then use our own.
The us sells us gas from $5 to $7 per gallon.
The us buys gas from everyone else for under $2.

What people think the us is doing and what they are really up to are light years apart.

It is not like the oil thing is a consperacy. The oil is sold on the spot market. A very large part of US oil consumption is for electricity. It is cheaper to burn high sulpher oil and scrub out the stack fumes. The US produces low sulphur oil.

Well look at some a the junk movies that are coming out. No wonder not one wants to buy them or go and see them. I have not bought a movie in a long time but then again I use netflix. For the price I pay for that I cannot even go to a movie.

You are so right jziman, they are putting out lots of junk. BB and Netfix buy enough of even the worst junk to keep them in business. With BB I am getting movies for less than 1 USD for the family vs 10 per head! I really don't mind spending a buck to see junk but I do mind spending 50 so my family can watch a junk movie.
