American federal agents can now take your laptop, iPods without reason According to new border search policies disclosed by the Department of Homeland Security, federal agents may take your laptop or other media devices for an "unspecified" period of time even without any suspicion of wrongdoing, in an effort to "prevent terrorism."
Additionally, the officials may share any content of the laptop or device with other agencies or private companies for "language translation, data decryption or other reasons."

The policies are dated as of July 16th by the U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement but the DHS says the policies have been in effect for "some time now."

"The policies . . . are truly alarming,"
adds Sen. Russell Feingold, a Democrat from Wisconsin who has vowed to look into the new border search policies. Feingold also plans to introduce legislation that will force the government to have "reasonable suspicion" for searches. The legislation will also limit racial and religious profiling during searches.



The policies effect anyone entering the United States, including US citizens. Civil liberties and business travel groups have been pressing for months to have the government disclose publicly these policies, after receiving complaint after complaint from international and US travelers that have had their laptops, iPods and even cell phones taken, sometimes for months at a time.

To quote exactly from the policies, federal officers can "detain any device capable of storing information in digital or analog form for a reasonable period of time" to "review and analyze information." They may do this "absent individualized suspicion."

"Any device capable of storing information in digital or analog form" means anything from iPods, laptops, cell phones and hard drives to, I kid you not, books and "written materials commonly referred to as 'pocket trash' or 'pocket litter.'"

Although there are protections on "business information and attorney-client privileged material" there is no protection on personal data of citizens, including medical or financial records.

"They're saying they can rifle through all the information in a traveler's laptop without having a smidgen of evidence that the traveler is breaking the law,"
said Greg Nojeim, senior counsel at the Center for Democracy and Technology.

Homeland Security Secretary Michael Chertoff wrote last month in USA Today that "the most dangerous contraband is often contained in laptop computers or other electronic devices." He recalled times where searches have uncovered "violent jihadist materials" and hard drives full of child pornography.

Earlier this year the US Court of Appeals upheld the government's right to conduct searches without any suspicion of illegal wrongdoing.

wtf? what kinda s*** is this? I am a us citizen, and have been since birth. I would like to see them try to justify confiscating my voodoo µ:703, for no reason, when all it has on it is pc games... not an mp3 or anything, It being a voodoo would also feather strengthen my case that they were trying to steal my expensive gaming laptop. I would allow them to examine the data on it, and confiscate the hard drive(s) at the very most, only because i have nothing to hide, provided they were going to reimburse me the money for a new drive, on the spot. They have no need for the rest of the hardware, as i would never see it again, even if i did it would probably be scratched up (considering its in mint condition atm).

what a stupid policy, if somebody did have some kind of terrorest evidence on theres all they would have to do is "accadently" drop it when handing it over, once the drives arm snaps on impact and scratches the platters when powered up, so much for evidence...


Why doesn't bush stick to what he knows best? terrorizing foreign (probably innocent)nations...

I really like how the government tries to make us feel safer by saying it's to fight terrorism. The war on terror is a ruse to get us to submit to tighter laws taking away our freedoms and rights. I don't feel any safer knowing that the U.S. government has such tight control over us. In fact it makes me feel less safe knowing that incompetent imbeciles are there to protect me.

I know that the 4th amendment pertaining to "being secure in ourselves and our papers" existed for our homes, but now the prevention of illegal search and seizure without warrant is need more than ever.

Look I'm all for the goverment protecting me but This just plan stupid and it even promotes/allows racism.

I second that more then half the stuff will end up "missing" or "missing" the return address information by the time its time to mail it back to you. and im sure it says somewhere that all unclaimed items become the property of the government. Just because its not worth it for somebody to rip off your $400 dell dose not mean they wouldn't try it with better stuff.

I'm thinking of myself and my stuff (which i worked dam hard to get) (you can call it selfish or what ever you want)because the goverment sure as hell isn't if they have there way they will abolish social security and Medicare and I will have to work till the day i die. the government was on prior notice of 911 yet they did nothing to prevent it, now they are joking around with this crap to try and look like they give a dam, This is the biggest joke (and insult) yet. That's the sad part...if the law prevails, they CAN do it, and not pay you a single penny...

Of course I wouldn't let them touch my expensive electronics...If they want them to charge me for a crime, I'll give them a good reason, beating up and probably ripping the head of anyone that confiscates my electronics for no good reason...

Lowest taxes and best social programs? To and for whom? I won't get into stereotypes, but the type of racial profiling that is discussed in this article are the same people who reep the rewards of "lower taxes, better social programs". It sounds like bigotry on my end, but all I can tell you is that I'm a born American citizen who loses 30% of my paycheck up front to taxes, then spends another 6-7% on sales taxes when I shop for goods or even higher rates when I fuel up my car, so I CAN commute to earn a living.

I do not benefit from any social programs and the few that I, or any of my friends have applied for, such as financial aid for education, just doesn't come easy for the middle America that largely support these programs with their sweat and blood. It's this same middle America that has to tolerate these ridiculous laws, all in favor of "fighting the war on terror." Our government has a huge deficit and is more worried about doing things abroad, then the issues facing us here. New Orleans anyone?

Then there are countless stupid laws meant to constrict my free time, such as DMCA, and jobs being shipped overseas. Also, I am legally not allowed to play online poker, because it "could fund terrorism", yet I could flip on my satellite tv any hour of the day and bet on horse racing. Once great companies like General Motors are now being crippled to the point where they may disappear. What the hell happened to this great nation of ours in the last few years?

I get intimidated and asked questions when trying to re-enter my OWN country from Canada, in 2002, 2003 and 2004. I guess my state issued driver's license and notarized birth certificate, both legal documents that can be traced and verified, aren't satisfactory enough: now I will have to shell out $100 or more to get a government issued passport. Now pile on the fact that they can search and seize pretty much anything they want at the border. The last thing I need to worry about is lying about whether I've been in/out of the country enough to qualify for the Duty Free.

I'm sorry, I may support our troops, but I don't support our wars. They make terrorism out to be like the school yard bully, hunting you down for your lunch money, until you pop him once with your fist, and everyone realizes that he's not as tough as he said he was. We as Americans need to grow up and learn to take matters into our own hands instead of crying "poor me" and whining to have someone else take care of it for us. Otherwise the bullies will keep bullying us and we'll just keep taking it where it hurts.

Oh hell, I didn't even get started on the NRA and our right to bear arms. That's for another discussion.

I'm so glad that I recently moved to Canada, at least people up here stir up a shitstorm when crap like this happens. This is just one more thing to make border travel even more horrible than it already is (yes, that IS possible). No more taking my laptop or personal paperwork across the border, except for my passport. It is looking like "unreasonable paranoia" isn't so unreasonable after all... Yet another way that the constitution is being shat upon by the government that it created.

@SProdigy: I hate to break it to you, but getting a passport will not prevent them from hassling you.

The one piece of advice i have for anyone who wants to cross the border is to be compliant, but not helpful. Don't offer information unless you are asked for it, and don't offer to let them search your vehicle unless asked. I know it seems counter intuitive, but those behaviors will only cause problems. And for those who ask, yes, i did find these rules out the hard way.

The problem is that free countries are inherently insecure to start with. The only way to provide security is to take away the freedoms that security is supposed to protect. Maybe next time, the gestapo will be kicking in our doors in the middle of the night to rifle through whatever we may have, and "extraordinarily render" us to a place where they will proceed to "humanely interrogate" us. Personally, i would rather have all of my rights intact, and take the chance of being killed in the terrorist attack. I would say the odds are in my favor (2750 killed on sept. 11 out of 300,000,000 in the country, as opposed to 300,000,000 out of 300,000,000 people being screwed out of their constitutional rights).

Actually I'm struggling to see what point you are making.. The people who wrote the constitution were trying to build a better democracy that the one that gave them no vote and treated them like slaves and property. US democracy was not the model for most European democracies.. they decided what they wanted for themselves, strangely enough mostly well before 1945. It is so terribly depressing travelling through the bloggosphere and visiting places on the Internet. So many ideas, so many discussions, so much talk! Yet everything sooner or later disappears as if through a black hole or gets drowned in the babble of voices struggling to be heard (including this one!). There is nothing left. No light! Most of us remain if not as ignorant, at least as impotent in the face of the challenges and threats we face today and those we will be facing tomorrow, as when we first embarked on this "electronic" search for a better world. Blogging, as it is presently, is indeed a very passive activity but it has a dark side to it also in that it lulls us into a false sense of comfort and satisfaction. I am thinking that perhaps there is a need for more "active" blogging. Not that discussion and pondering and ranting are no longer useful and should be thrown on the scrap heap. What if along with all that there was also sharing of the concrete actions that one is taking in one's own particular life for the advancement of a better world. For example, along with ranting against the big bad US invading Iraq for oil, why not also add what one is doing PERSONALLY to reduce one's own oil consumption - SUV or hybrid? What group have we joined and what concrete steps is it taking for a better world? How can others join? I fear that unless we learn of creative ways - or share them if we already have them - to transform today's "echo chambers" (which is what the Internet and the bloggosphere for the most part have become) into some kind of "launching pads" towards real activism in the real world, we will remain trapped with each other, albeit in a "wonderful world of intelligent discourse", talking to each other, across each other, about what we should be doing or what we should be thinking, instead of going out there and really tackling the problems. It would be interesting, for example, to have on this site maybe a listing (or links to listings) of TRUE activism (community, grassroots) instead of COUNTERFEIT activism (corporate-backed or government-backed activism disguised as the former !). In other words, action (and ideas always of course!) but not just talk. Talk is cheap! We can't afford it anymore!

But they will have to kill me to get their hands on any of the five I own and use on a daily basis. And my moded XBOX including my five external hard drives. All behind three firewalls. Two hardware and one software. Yes I'm a pirate I don't care. My 51yr old mother downloads music and movies as well. Does she see anything wrong with it. Hell no! She knows because I've informed her that the artists make a majority of their money on tour. Not through record/cd sales. And the actors get paid weather the movie does great or bombs. Protection against unwarranted search and seizure is our 4th amendment. Why doesn't it offend you that this is being violated? Why are you so quick to give up your freedom? Quite frankly, there is now no effin way I'm nipping over to NY to do my Christmas shopping if every storage device I have is liable to this.
Can't live without my phone, lappie and mp3 player. You lose out on some extra bucks......Then again, I have a sneaking suspicion that I'd be the wrong racial profile to be a suspect. This all sucks big time and I'm letting all my friends know about this - friends that spend money in The States. No more Euros for you.

Thanks for providing some educated support greensman, I really appreciate it, seeing as how these individuals seem to have little understanding, and to mr. "I'm going to leave the U.S. for Canada" lets set some things straight, I am not from Texas, that would be GM, and I attend Whittier College, one of the most liberal colleges in the US, and I don't see how anything I have said relates to the Civil War or slavery, and it is completely ludicrous to relate the US being able to search your laptop to slavery, and that is all I will say about that because you waste my time with that assertion...

I also don't understand how this is flawed logic, the fact is, terrorism exists and in order to keep ourselves safe, we must forfeit some freedoms, and I personally feel like giving up my laptop isn't that big of a deal if it means I'm a little more protected.

Frankly, they aren't taking your homes, its just your computer, and although you all might be married to the damn thing, it shouldn't really matter all that much to you...

On a final note, I enjoy how everyone seems to commit themselves to all the propaganda they find on the internet...Guess what, our friends in the United Kingdom and throughout Europe pay at least twice as much for gasoline as we do...Government hardly controls the cost of oil, rather it is OPEC and investors, if you would all just take some time to watch the market you would understand this...honestly

You can think what you want.. We see the parallels too clearly as we have not yet been brainwashed by the corrupt.

Great men wrote that piece of paper you wave around. It wasn't so much a statement of revolution as a way to avoid one in the future. They were aware of what was happening in France and were trying to avert what will come in America now one day because of the path chosen by the rich and greedy of oppression. Continue being subservient and meek.. I can tell you.. the meek shall inherit bugger all.. because the rich and greedy won't let them have any.

Maybe if you lot had ever had your borders threatened by a totalitarian regime.. or had some bombs fall from the skies, or had the jack boots of the enemy stamping in your streets and kicking down your doors you would see these despots for what they really are, instead of seeing them from what they tell you.

Obviously it is a sad day when a real Nazi like me has to educate so called "free men" on the values of liberty. Liberty and freedom are non negotiable.. you either have them or you don't.

Whoa varnull I think you went a little too far how can you substitute a jew for a terrorist? The war we are in now is over oil and has been all along. Do you you think we would give a flip over the middle east sand box if it weren't loaded with oil. Afghanistan is where the terrorism originated but they didn't have any oil so the war was moved conveniently to protect (control)the oil.

To everyone who feels like we need to give up freedom for "security"...First of all we aren't any more secure with less freedom now then we were with our freedoms before 9-11. If anything we are less secure since the institutions within our government, which are supposed to protect us, are run by crooks and incompetents--not to mention that were at war which certainly doesn't help with our security. The President is going to have to start saying "they hate us for our security," when we don't have any freedom left to resign.

By the way, freedom isn't a partisan issue. If you believe it is, than you probably have more loyalty to your party than you do to your country.
