Update: IFPI and Pirate Bay to do battle over domain name

In an update to our article here, where it was reported that The Pirate Bay had somehow gotten the rights to the domain name IFPI.com, it seems the IFPI will now be preparing a lawsuit to get the domain back.

According to an IFPI spokesperson, "IFPI's website www.ifpi.org continues to operate as normal. The web site www.ifpi.com was acquired by a cyber-squatter who appears to have passed it on to an associate of The Pirate Bay," she said. "IFPI has already taken legal action to get the domain returned. We have filed a complaint at the World Intellectual Property Organisation (WIPO) under the dispute resolution procedure. This procedure is designed for classic cyber-squatting cases such as this which involve the use of a URL in bad faith."

The WIPO has indeed made new legislature pertaining to "cybersquatting" with rules that include that the domain cannot be used to "cause confusion with the complainant's mark" or be used to profit off the complainant's good name.

One of the admin team at TBP feels they have a strong chance of winning however.

"We have not done anything illegal or even immoral," he said. "I can't see why we shouldn't be able to keep the domain name. We're not going to bash IFPI on it, we're going to host our own IFPI on it," he added.

The Pirate Bay even says right on the website (IFPI.com) that: "International Federation of Pirates Interests should not be confused with The International Federation of the Phonographic Industry." They even link directly to IFPI.org when you click on "The International Federation of the Phonographic Industry". This, in my opinion, is not Cyber Squatting. If they "stole" IFPI.org then they might be in trouble. [ + quote]

It reminds me of the WWF WWE thing. I don't think Pirate Bay has much of a chance of winning this, but it's just funny what they're trying to do. It's just their way of saying "You wanna play hardball? We can play hardball." [ + quote]

i dont get it.i go on ifpi.org and its the normal site.i go on the .com version and it says international federation of pirate interest as the title but the page has nothing on it.so why is this such a big deal? [ + quote]

You can only hold 1 domain name for a company. A guy named nissan in the USA found this out when Nissan the car company took him to court for having nissan.com and .org domain names. He has 2 companies, one uses nissan.com for a computer company the .org is used as an importer/exporter business he also has, he won the first time but the appeal he lost because he couldn't prove that he really needed 2 domain names for which is basicly just advertising the same guy. So I don't think the pirate bay will lose as such but they are playing on the name which will effect things such as the WWF and WWE thing. so it's a wait and see I suppose. [ + quote]
