your right in the fact that the product dont necessacerly have to work to get a patent, but if indeed that is the case, the $3000 - $15,000 they spend on a non functionial patent will be lost, and the one who modifies that idea can then submit the plans to a patent using the modifications that inventor "B" came up with to make that patent work and get his/her own patent all you need is two or more claims of the changes in the patent you used to get it to work.
also it is up to the technition of larger electronics corps to test wether the IDEAs are fesable to use in there product or not and if the patent is for a bogus product it is going to be difficult to try to manfucture that bogus product into an item of quality seeing it cant technicaly work.
I do agree with you to a small extent on that, one should only submit patents that have been proven to work.
this would keep bogus products from appearing.
a good example of bogus products that have made there way to the market and never should have is the cell phone antana sticker that claims to boost range.
as well the rid-x product that is truly an over glorified night light
(it dont have any effect in repelling pests at ALL)
but you do have a not so aware public that puts faith and swares that they do work (placibo effect?)
in all truth these inventions should have never hit the market as well as in being sued for false product advertising.
another problem I my self expierence is with batterys actualy holding their listed capicity. yet the general public would buy one that holds ten percent of raited capicity and sware it was holding its full potential being non the wiser. This is what hurts the moderen inventor the most I think.
I agree fully in that
aspect, products should be tested to see if they function proir to being patented...or sold.......

ps. I think the people that are sueing sony had the first working blue ray disk as well as drives they were a small company that was working with the technology and inproving upon it since sonys release
of blue ray other companys have inproved upon it making the dual layers up to 20 layers in thickness raising the data storage efectively from 40-50
GB to 200+ GB. the original inventors may have also been working on this to perfect it for a final release.
who realy knows how many data layers can be used.
the blue ray technology is a work of genious actualy using a holigraphic
image to store thousands of times the data where a single bit would have been on a
cd or
dvd disk.
target also sued sony a while back on a similar subject claiming that a protective surface that was invented by them found their ways into BLUE RAY disk without there permissions. and the
psp SKYPE calling feature is also stolen from a
psp homebrew coder that was under the free GPL (general public licence) copy right. All they did was change the name! The first was "Furikup v0.1.12" that alowed
skype calling from any SIP SERVER of your choice only playable on homebrew
psp they stiffed this guy of all his hard work calling him a HACKER in the process yet he owns the originial source code and made it viewable to the general public via [url=http://dl.qj.net/Furikup-PSP-SIP-Phone-v0.1-PSP-Homebrew-Applications/pg/12/fid/15622/catid/189 ][/url] a few months later sony stole the idea and incorperated it into there psps. this guy should have the right to sue sony as well for each psp product that uses his software code with out permissions from the author. and because psps are updatable to moderen firmwares that uses the
skype app this would be all psp's modern and slim that potentialy could be updated to firmwares that use this SIP program.
the sony corperation is a bunch of thieves stealing many ideas and actual products that many other people have put a lot of hard work into making or worse thinking up to make functional.
I as an inventor have run into similar problems my self as I INVENTED THE WHITE SOLAR POWERED PATHWAY LIGHTS. I had these for a year and a half before they hit the market in which they were literaly stollen from my yard hitting the market only 3 months after they were stollen.
coleman did it to me as well. I invented a lantern that used 9 watts of power and generated 60 watts worth of light. some homeless guy stole it and now the product is marketed.
and others that have been stolen that I am still waiting to hit the market!

IDEAS have meaning I mean the idea for a light bulb was around before light bulb. Thomas edision found over several hundred ways to "NOT MAKE A LIGHT BULB" before he invented a version that actualy worked.
his idea was basic in princible find a wire that will not melt and will glow bright when an electrical curent is passed through, some lights were preshurized while others were in a vacume he noted that the componets used in a vacume would last longer then the ones that were in an oxygen atmosphear.
IDEAS MAKE PRODUCTS.
though in some aspects things should be reviewed to make certain the idea works before a patent is obtained. I mean all my products did work and worked rather well but as for pattents I never had the moneys to get one for there extream costs which have resulted in many of my inventions being stolen, BUT HEY I HAVE ONE IDEA THAT MIGHT BLOW YOUR SOCKS OFF AND MAKE THE HOVER CAR AND INTER STELLER SPACE TRAVEL A POSSIBILITY all I have to do is make a prototype and or get the moneys necessary to submit a patent.
another challenge though is inventing something that someone else had invented. when I was 13 I had inadverently invented an ION PROPULSION ENGINE that N.A.S.A. has been using for the past 30 years in space probes. IE. VOYAGER 1.
Imagine my suprise when I saw some thing I drew in ignerence,(without the knoweledge that it was in use by nasa) on a NASA websight that they had been using for years!
this is why it is importent to patent the IDEA so someone else dont take your idea and call it theres.
if sony wanted blue ray they could have had it by simply purchising the patent rights from the inventor or by giving the inventor an agreed upon royality settlement (contract to use the patent rights of the inventors ideas or products giving an inventor a small amount of monny in percintials for the said products retail value) example
royality payments of 5 percent is $50 on a $1000 BLUE RAY PLAYER where as the $50 is payable to the inventor for the products value for each thousand doller unit sold.
and yes sony made the product but so did the small company that is sueing sony and it all came from an idea of an inventor or a group of scientiests.
these ideas are worked on to try to manufacture the product so that a product is made, or the product made by one inventor can be stollen by a thief, who claims to be the inventor though isn't!!
and the inventor sleeps in a ditch cause he never got any of the credit that was due him for his/her inventions that others stole and marketed.
