Apple sued over iPhone MMS

Apple and AT&T have been sued this week in Louisiana over alleged misrepresentation of MMS availability on the iPhone.
The class action suit says, according to TGDaily, that "both companies aggressively promoted the MMS features of iPhone OS 3.0 and the iPhone 3GS using advertising on TV, radio, newspapers, direct mailers, and on the Internet," although it was not really available.

There are so far over 10,000 people represented by the suit.

AT&T is added in the suit because plaintiffs allege that the carrier does not have cell towers that support MMS. As proof they point to the WWDC 2009 keynote where an Apple created slide does not show AT&T as a vendor that supports MMS.

It will be interesting to see where the suit goes, given that AT&T has noted that MMS support will be coming "by late summer."

My phone came out years ago and has more features than the iphone, people buy what they see on TV without researching. I do feel sorry for you iphone users.

Ummmmm yea. The iPhone has more features than anyone will ever need. It's just missing some key features that are working flawlessly with other phones. Didn't buy it because I saw it on TV either. I bought it because I like it and it is an excellent phone. I've used plenty and the iPhone is the best from my experience. I don't speak for all but think most iPhone users don't care how you feel so save you’re sorry for somebody who needs it.

The iphone is great at some things, and unbelievably bad at other things. Once jailbroken, they are downright nice. Becides, what other phone will heat up a cup of soup?

You got a point there. They get hot as hell and it's worse since 3.0.

If I felt I really needed a mobile web browser w/ my phone, I'd definitely get an iPhone, but I'm a 'basic needs' person when it comes to most electronics and don't care much about extra features.

The tethering hack is out there just look for it. I did my 3GS the day I got it and havent had a problem yet. ATT sucks. I hope they get there @sses sued off.

I feel a phone should be used as just for that, a phone. As in people forgot the meaning of calling people. But hey, to each their own, I am not discriminating against those who love their I-Phone or any other multi-media/usage phone. When it comes to cell phones of any sort tho, I prefer ones that don't have the ability to keep me warm in winter, and long ass batter life that has no or little chance of exploding on their own without tampering.

I-phones are great toys though once jail-broken, but in the end it's just a toy. I can see them losing this lawsuit tho; after all a broken promise on a written contract is a broken promise begging to be paid out.

I don't need your pity. My iPhone 2G sends mms and records video. And I recently found Google Voice...take that Apple!!!

You don't even need to jailbreak your phone to access the MMS and Tethering abilities. Just need to update to the 5.0 carrier settings...

That only works if you have a family plan and the other phones on the plan are not iPhones and have MMS. Unless I'm missing something and if so please enlighten me......

i prefer electronics that do what there intended to do no more no less.

usually extra features mean there trying to cover up something that doesn't work as well as it should. in cell phones its usually the calling part.

Personaly, I don't need a mobile web broswer on my phone, and if I did, it would probably be for a web-based app that does not run on a phone. However, if I decided to go with a web phone, there are many better solutions than the iPhone. People don't buy the iPhone because it has good call quality, reliability, or performance. They buy it because it is on TV every other commercial break, and because they are too ignorant to do a simple google search like "Would you recomend an iPhone 3GS". Anyone who complains about their iPhone is just complaining about their own ignorance in buying it.

I've been reading around on how essentially "activate" teathering at least. However all the options are risky to other components on the iPhone and you could be possibly charged for it. Not worth the chance via hacks.
